REACH: What is it and how will it affect my business?
REACH is the European Regulation for the Registration, Evaluation, Authorisation and Restriction of Chemicals. It entered into force on 1st June 2007 to streamline and improve the former legislative framework on chemicals of the European Union (EU). REACH places greater responsibility on industry to manage the risks that chemicals may pose to the health and the environment.
All EU-manufacturers and EU-based importers producing or importing substances into the EU in volumes of 1 ton/ annum and more will be affected by REACH. They will have to register each of these substances (as far as it is not exempted from registration). Failure to register effectively means that the substance would not be approved for manufacturing in the EU nor would it be allowed to be imported into the EU.
Non-EU manufacturers exporting into the EU will also be affected indirectly because of the obligations of their customers. Therefore, if you or your customers have businesses in the EU or export chemical substances to the EU, you need to be aware on how your business will be impacted by REACH.
Non-compliance with REACH will mean that your products may not be able to be legally placed in the EU after 1st December 2008.
Bearing in mind the complexity of REACH, it is therefore vital that you keep abreast of REACH and prepare yourselves to meet the requirements to stay competitive.
